These Regulations governs the organization and conduct of the Startup Connect Contest (hereinafter referred to as the Contest) for the startups competition, implemented as part of the Startup.Connect cross-border cooperation project funded by the European Union, the Russian Federation and the Republic of Finland in the framework of South-East Finland-Russia CBC 2014-2020 programme (https://www.sefrcbc.fi).
The goal of the Program is to support startups, student entrepreneurship, small and medium-sized technological businesses in the cross-border region in order to create a community of business leaders ready to enter the global market. The operator of the cross-border cooperation project Startup.Connect is Cursor Oy Company and acts as the Contest Organizer.
Terms and Definitions
Application - information provided by the Applicant when completing and sending an electronic registration form on the Contest website.
The Jury is a group of experts (members of the jury), deciding the choice of finalists and winners of the Contest. The composition of the Jury is formed by the Contest Organizer from representatives of the Organizer and / or invited experts.
Applicant - a legal entity, an individual entrepreneur or a group of individuals without a legal entity (capable and competent individuals who have reached eighteen years of age), which has sent an application for participation in the Contest in accordance with the terms of these Regulations.
Contest - Startup Connect Contest for early stage technological projects from South-Eastern Finland, St. Petersburg and the Leningrad Region.
Organizer and Customer – Cursor Oy, Kotka-Hamina Regional Development Company, Finland, Business ID 0727178-6, location address Kyminlinnantie 6, P.O. Box 14, FIN-48601 Kotka, Finland.
The operator for receiving applications (hereinafter referred to as the “Operator”) – IT Innovations Fund. Location address: 197046, St. Petersburg, Chapaeva St., 11/4-38. Details: PSRN 1147800002790, TIN 7813292056.
Finalist - the Applicant, who, based on the evaluation of the Jury, was selected to make a presentation in the Final.
Winner - the Applicant, who, according to the results of the Final, was recognized by the Jury members as the winner of the Contest and awarded the Prize.
Awards - prizes awarded to the winner of the Contest. Awards include participation in the Acceleration program and participation in activities for startups. The procedure for obtaining and using awards are governed by these Regulations.

1. General provisions
1.1. These Regulations governs the organization and conduct of the Contest.
1.2. Information support of the Competitive Selection is provided by the Operator. The Operator ensures that potential Applicants are informed of the Competitive Selection, promotional and information materials about the Competitive Selection, as well as all information about the Competitive Selection on the Website, on social networks, as well as in other ways as agreed with the Customer.
1.3. The Operator and the Customer have the right to make changes to these Regulations with the obligatory publication of such changes on the Website. Changes take effect from the date of their publication.
1.4. The purpose of the Contest is to support startups, student entrepreneurship, small and medium-sized technological businesses in the border region in order to form a community of business leaders ready to enter the global market.
2. Contest conduction
2.1. Applications for participation in the Contest are accepted from 12.00 on April 2, 2019 to 23.59 on June 10, 2019 (hereinafter we mean time of Helsinki, Finland).
2.2. According to the results of the entries, the Jury selects up to 10 (ten) Finalists. The list of Finalists is published on the Website before 3 pm on June 28, 2019.
2.3. The Final of the Contest is a presentation session, which is held during the *Ship Startup Festival in Kotka (Finland) on August 1-2, 2019.
2.4. According to the results of the Final, the Jury will select 1 (one) winner who will receive the Awards.
2.5. By taking part in the Contest, the Applicant thereby confirms his acceptance of the terms of these Regulations by sending the Application. If the Applicant does not agree with the terms of these Regulations, he should not submit an Application for participation and participate in the Contest.
2.6. All Applicants who have filled in the required fields in the Application on the Website are allowed to participate in the Contest, who have agreed to the terms of these Regulations by placing the “V” icon when submitting the Application, who have given their consent to the processing of personal data, received confirmation of the receipt of the Application by the Operator to their specified email address.
2.7. Only those Applicants who have been selected by the Jury on the basis of the criteria established in clause 4 of this Statute are allowed to participate in the Final Contest.
2.8. Contest Applicants - Finalists independently bear and pay all costs in connection with participation in the Contest and the Final. At the same time, the Organizer provides a free bus transfer for the Finalists from the city of St. Petersburg to the city of Kotka and back, and also provides rooms for staying at a hotel on 1 (one) night (1-2 August 2019) to participate in the Final. Compensation of any costs to the Applicants, associated with participation in the Contest, including the purchase of travel documents (tickets) and accommodation, are not made by the Organizer.
2.9. The Customer and the Operator are not responsible for the safety of property and equipment of the Applicants at the venue of the Contest stages.
2.10. Contest Applicants are obliged to:
2.10.1. Refrain from any actions that may cause damage to the Customer and the Operator, as well as those associated with risks to life and health during the Contest.
2.10.2. All materials provided in the Application, as well as the product itself, should not contain information constituting a secret protected by law, including information about the private lives of individuals, encourage violence, racial discrimination, terrorist or other illegal activities, other extremist materials, contain materials that offend religious feelings of believers, elements of pornography, as well as violence or cruelty, or illegal actions; contain abusive words, obscene and offensive images, comparisons and expressions, including with regard to professions, age, language, official state symbols of the Russian Federation and the Republic of Finland, objects of cultural heritage of peoples; contain information about the stay of minors in a state of danger to their life and / or health, elements of use, demonstration of tobacco and / or alcohol, drugs; contain objects that are the intellectual property of third parties; contain information and (or) materials violating other rights and interests of citizens and legal entities, requirements of the legislation of the Republic of Finland and the Russian Federation of public morality and ethics.
2.10.3. By providing information and materials, the Applicant confirms that such information and materials are not confidential, including those that are not protected as commercial secrets, and contain no signs of know-how.
In case of non-compliance with the above obligations, the Applicant may be disqualified and removed from the venue.
2.11. The decision on the compliance of the project or the product of the Applicant with the requirements established by these Regulations shall be made at the discretion of the Customer. The customer has the right to refuse to give the reasoned refusal of the applicant to accept the application after its processing.
2.12. The customer forms, at his discretion, a list of Applicants who meet the formal requirements established by these Regulations.
2.13. The Applicant has the right to withdraw the Application for participation in the Contest by filing an e-mail notification to the Customer at least 10 (ten) calendar days prior to the deadline for receiving applications.
2.14. The Customer has the right to refuse to participate in the Contest at any stage at its discretion by notifying the Applicant in any way available to the Customer.
3. Awards for the winner
3.1. The awards of the Contest are participation in the Acceleration program and participation in Events for startups.
3.2. The venue for face-to-face activities of the Acceleration Program is the city of Kotka (Finland) and the city of St. Petersburg (Russia).
3.3. The schedule of activities of the Acceleration program will be published on the Website until August 01, 2019. The terms of the Acceleration Program may be changed by the Customer with the notification of the Applicants by posting relevant information on the Website.
3.4. The acceleration program is aimed at finding by the Customer new products / technologies / devices / solutions and talented teams among Applicants, identifying their commercial potential, ability for productive communication and business development, and identifying prospects for further commercial cooperation between the Customer and the Winner. The acceleration program is not a stage of negotiations, is not a tender for the conclusion of a contract, or a public tender in accordance with the legislation of the Republic of Finland or the Russian Federation. Any results of the Acceleration Program do not oblige the Customer and the Winner to conclude an agreement with each other or otherwise continue cooperation. Any correspondence of the Customer and the Winner in the framework of the Acceleration Program are not any negotiations, and any such discussions and data in the course of the correspondence, discussion of the promise do not have legal force.
3.5. Participation in the Acceleration Program is free of charge for both parties. None of the parties is entitled to claim any financial payments or reimbursement of any costs associated with participation in the Acceleration program, except for the costs agreed below, which are covered by the Customer:
●travel to the venue of the Acceleration program for not more than 2 (two) representatives of the Winner if the Winner is registered in St. Petersburg or the Leningrad Region, from St. Petersburg, Russia to Kotka, Finland, and back at the end of the Acceleration program (the terms of compensation are agreed upon by the Winner and the Organizer individually); if the Winner is registered in South-Eastern Finland - travel from South-Eastern Finland to St. Petersburg, Russia and back at the end of the Acceleration program (compensation conditions are agreed upon by the Winner and the Organizer individually);
●accommodation for not more than 2 (two) representatives of the Winner at the hotel chosen by the Customer at the venue and during the Acceleration program.
3.6. Participation in the Acceleration Program does not impose any obligations on the parties to each other and does not give the Parties any rights not directly established by these Regulations.
3.7. The applicant has the right to refuse to participate in the Acceleration program by notifying the Customer by e-mail. Customer inaction or violation of the terms of these Regulations shall also be recognized as a refusal to participate in the Acceleration program.
3.8. In addition to the Acceleration Program, the Winner gets the right to participate in the Events for startups: Web Summit on 4-7 November 2019 in the city of Lisbon, Portugal (hereinafter - Events).
3.9. The Customer covers the following expenses of the Winner for participation in Events for 2 (two) representatives of the Winner:
• for participation in the Web Summit: payment for the stand and entrance tickets (ALPHA participation package), air tickets to Lisbon from Helsinki, St. Petersburg or other points agreed by the Applicant and the Customer and return tickets from Lisbon, accommodation in a hotel in Lisbon during the Event.
3.10. The winner does not have the right to refuse to participate in the Events after agreeing with the Customer on the conditions for participation by e-mail. Otherwise, the Winner is obliged to compensate the Customer for the Customer’s actually incurred and documented expenses for organizing the participation of the Winner in the Events.
3.11. The Customer has the right to replace one or all awards with equivalent ones at any time of the competitive selection prior to the announcement of the Finalists of the competition. In this case, the Customer and the Operator shall notify the Applicant about the replacement of the Award by e-mail specified in the Application, as well as post the updated information on the Contest Website and in these Regulations.
4. The procedure and criteria for the evaluation of the applications
4.1. The selection of applicants for compliance with the objectives of the Contest is carried out by the Customer prior to the transfer of applications for consideration by the Jury according to formal criteria:
● All required fields of the Application are filled in with the corresponding data;
● the focus of the project described in the Application corresponds to one or several technological priorities indicated on the Website;
● availability of a prototype or minimum viable product (MVP);
● an opportunity to present the project in English by one of the founders.
4.2. The Organizer has the right to request at any stage an additional necessary information from the Applicant, including but not limited to information about the Applicant’s project itself, documents of the sole management body, scanned copies of certificates of registration of legal entities and tax registration, documents of title to the product and other documents. All information and documents must be provided by the Applicant within the time specified by the Customer and via the communication channels specified by the Customer. This information is necessary to verify the reliability and integrity of the Applicant and the product.
4.3. The Customer has the right to conduct an interview with the applicant in the terms established by the Customer at any stage.
4.4. If the Applicant fails to contact the Customer, if the Applicant fails to submit the required information and documents within the specified time, refuses to be interviewed, or fails to attend the interview within the time specified by the Customer, such actions are interpreted as refusing of the Applicant from further participation in the Contest, Acceleration Program or Events without any notice.
4.5. When selecting the Finalists and the Winner, the Jury will evaluate the Applicants at their discretion, in accordance with the following criteria:
● problem and solution (how significant is the problem addressed by the project, how interesting the proposed solution is, how well it is worked out);
● market and business model (market size, competition, clear business model);
● technological innovation (as far as the solution has a technological competitive advantage over existing analogues);
● current results and scalability (clients, investments, revenue, other significant results confirming the viability of the project);
● team (the presence in the team of a complete set of competencies required for project implementation, a strong manager-entrepreneur, mentors).
4.6. The Jury evaluates the Applicants at their own discretion and the Applicants do not question the decision of the Jury. The Customer shall not reimburse the Applicants for any losses related to the non-recognition of certain Applicants as the Winner, incl. and due to non-compliance with established criteria.
5. Rights and obligations of the parties
5.1. The Applicant has the right to take part in the Contest in the manner determined by these Regulations.
5.2. Submitting an application for the contest means that applicants agree that their names, surnames and other materials about them, images of Applicants (including photographic materials, video materials) can be used in any way by the Customer and their authorized representatives to inform the Applicant about qualifying rounds and to make other announcements of the Contest, Acceleration Program or Events, as well as in press releases and articles about the Contest in the media, social networks and instant messengers without completing an additional agreement with the Applicants of the Contest and the payment of any compensation.
6. Final provisions
6.1. The Contest, these Regulations, as well as any activity related to the Contest, including the Acceleration Program, Events and other Awards, are governed by the laws of the Russian Federation, the Republic of Finland and the European Union.
6.2. Under no circumstances shall the Customer bear any responsibility to the Applicants, in addition to the expressly stated responsibility in these Regulations. No obligations of the Customer to the Applicants are not subject to fulfillment other than the obligations expressly specified in these Regulations. If the Applicants refuse to participate in the Contest at any time, the Customer and the Operator will not reimburse any losses to the Applicants that may arise in connection with the Contest.
6.3. The Operator and the Customer reserve the right to refuse the Applicant to further participation in the Contest at any time without compensation for any losses and expenses to the Applicants in case of violation of these Regulations.
6.4. The provision on participation in the Contest may be amended and supplemented at any time by the Contest Customer or the Contest Operator as agreed with the Customer.
6.5. Informing the Applicant, as well as any other communication, is carried out by the Customer by sending a corresponding letter to the email address specified in the application, or subsequently provided by the Applicant to the Customer as the main means of communication.
6.6. All information, documents and other materials sent by the Applicant from the e-mail address specified in the application, or which was later indicated as the main means of communication, are considered to be provided.
6.7. The Customer has the right to use in addition other contact information provided by the Applicant for informational purposes.
6.8. Information on changes in the collection and (or) processing of applications, changes in the terms of the Contest, Acceleration program, Events or other Awards, information on changes in these Regulations and other information intended for all Applicants is posted on the Website.
6.10. The Applicant consents to the use by the Customer of any information and materials provided by the Applicant, information, as well as a trademark (service mark), logo, company name, photo and video filming materials made within the Contest and Acceleration Program, incl. by posting on the Site, on the Internet, in advertising and PR materials, including pages on the social networks of the Customer, Operator, Partners of the Customer, for the purposes of informing about the Contest and its results.
6.11. The Applicant agrees that all information that he receives in the framework of the Contest is confidential, being valuable to the Customer and not subject to disclosure, because it has real and potential commercial value due to its unknown to third parties, there is no free access to it on a legal basis.
6.12. The Applicant is obliged to take all reasonable measures necessary and appropriate to prevent the unauthorized disclosure or disclosure of confidential information. At the same time, the measures taken must be no less significant than those that the Applicant takes to save their own information of this kind.
